In a significant affirmation of judicial discretion within the military justice system, the Supreme Court has upheld the Armed Forces Tribunal's decision to substitute a conviction and modify a sentence. The case involved a Colonel initially convicted by a General Court Martial (GCM) for corruption and illegal possession of ammunition, leading to his dismissal.
Upon review, the AFT acquitted the officer of corruption but notably exercised its powers under Section 15(6)(a) of the Armed Forces Tribunal Act, 2007. It substituted the conviction for ammunition possession from a 'civil offence' (Section 69 of the Army Act read with Arms Act) to an 'act prejudicial to good order and military discipline' (Section 63 of the Army Act, 1950). Furthermore, the AFT modified the punishment from dismissal to compulsory retirement with full retiral benefits, demonstrating its commitment to proportionate justice.
The Supreme Court, in its judgment, reinforced the AFT's authority to make such substitutions, provided the evidence from the original trial supports the alternative finding. This ruling underscores the appellate forum's critical role in ensuring that disciplinary actions are both lawful and just, balancing military discipline with individual fairness.
